Terms
Scope of work
The scope, deliverables, usage rights and price of each production are agreed with the client before work begins. Additional work or changes outside the agreed scope may be charged separately.
Copyright and usage
PENGVISUALS retains the copyright and rights to the original production material unless otherwise agreed in writing.
The agreed fee covers the finished deliverables and the usage rights agreed for the project. Purchasing a finished film does not transfer ownership of the original footage or production material.
The finished film may not be substantially edited, re-cut, altered or incorporated into other productions without prior agreement from PENGVISUALS, unless such rights have been agreed as part of the project.
Raw footage
Raw footage, project files, unused material and other source files are not included in the delivery of the finished film unless explicitly agreed in writing.
Raw footage and source material can be purchased separately and will be quoted according to the project.
Payment and cancellation
Payment terms and cancellation conditions are agreed for each production. Unless otherwise agreed, invoices are due within 8 days.
All prices are excluding VAT unless stated otherwise.
Client material
The client is responsible for ensuring that any material, music, images, locations or other content supplied by the client can legally be used for the intended production.
Portfolio use
Unless otherwise agreed, PENGVISUALS may display completed work in its portfolio, website and social media after the work has been publicly released.
Privacy
Personal information
PENGVISUALS only collects and uses personal information where necessary to communicate with clients, provide services, manage projects, issue invoices and fulfil legal obligations.
This may include names, contact details, company information, correspondence and billing information.
How information is used
Information may be processed by service providers used to operate the business, such as email, hosting and accounting services.
Personal information is kept only for as long as necessary for the relevant purpose or as required by law.
Your rights
You have rights under the GDPR, including the right to access, correct or request deletion of your personal information, subject to applicable legal requirements.
